TYPES OF CUSTODY

In Texas, custody is divided into two categories:

  • Conservatorship
  • Possession and Access

Conservatorship assigns parental duties to one parent or guardian as the decision maker. The parent selected by the court as the custodial parent, or the parent with conservatorship, is responsible for making many of the important decisions that affect the child’s life and wellbeing.

Sometimes one parent has sole managing conservatorship, or sole custody. In that case, the parent is responsible for making decisions such as:

  • Where the child will go to school
  • The kind of medical attention the child will receive
  • The type of religious instruction the child will receive
  • And other similar life decisions

However, when both parents share joint custody, which is called “Joint Managing Conservatorship,” these decisions are made by both parents.

The other type of custody is Possession and Access, or physical custody. This type of custody determines where the child will live. Both parents may have joint custody, while one is given physical custody.

HOW DOES THE COURT DETERMINE WHO GETS CUSTODY?

The guiding principle in a custody case for all Family Law courts in East Texas and Smith County is the “best interest of the child.” To determine what is in the best interest of the child, the court will look at:

  • The child’s physical and emotional needs
  • The safety of the child
  • Agreement between parents
  • Which parent has been the primary caregiver in the past
  • Keeping siblings together
  • If the child is 12 years of age, his or her preferred caregiver is also considered
  • And other considerations
